Q. Should I call the copyright holder if I think may company has any problems with software piracy or license non compliance issues? A. Nice question! Scary, but very nice!

The short answer - according to over 95% of the technology asset managers and software asset managers we have polled on three continents:
Not a single one of them was willing to trust the copyright holder to help them straighten out suspected software piracy or copyright violations.
There are plenty of completely valid reasons for this perspective. You may want to take notes so you don't inadvertantly wind up painting that software piracy audit target on your own forehead...

  • The so-called anti piracy help lines being operated by the copyright holder and their friends have nothing to do with preventing errors in copyright compliance. They are there to collect reports of piracy events to be investigated for possible audit. Call one of these (use a pay phone somewhere away from your company). These people operate off a script and merely listening to their questions will tell you what they are interested in helping you accomplish.
  • In many cases business technology consumers walk themselves right into a non compliance audit simply because they haven't read the license. Check out our Knowledge Briefing covering "Software Licensing: Permissive Documents on the Hunt." The bottom line is this: you are given very specific usage permissions with every license. Fail to follow them--for whatever reason--and you set yourself up for an audit.
  • These people are letter of the law believers. They not only crafted the licenses but they spent a significant amount of time and money ensuring that legislation favors their perspectives. Most likely, like me, you are not a lawyer. In other words, don't even consider asking the wrong questions without ensuring that you are 100% in the right.
